Gramm Terms of Service

These Terms of Service (“Terms”) govern your use of the Gramm mobile application and website located at gramm.mobile (collectively, “Gramm,” the “Service,” “we,” “us,” or “our”).
“Gramm” is operated by AP Prints, a New Jersey business (“AP Prints,” “we,” “us,” or “our”).
By downloading, installing, accessing, or using Gramm, you agree to these Terms. If you do not agree to these Terms, do not use Gramm.
Important — Not Medical or Food-Safety Advice
GRAMM IS A MATHEMATICAL CALCULATION, COMPARISON, AND BUDGETING TOOL PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. IT IS NOT A MEDICAL DEVICE, HEALTHCARE SERVICE, NUTRITIONAL PROFESSIONAL, DIETITIAN, PHYSICIAN, OR OTHER HEALTHCARE PROVIDER.
Nutrition values, calories, macronutrients, protein density, serving sizes, prices, package sizes, and other product information may be estimated, incomplete, outdated, user-entered, or incorrect.
DO NOT RELY ON GRAMM AS YOUR SOLE SOURCE FOR ALLERGEN, INGREDIENT, DIETARY, MEDICAL, OR FOOD-SAFETY DECISIONS. ALWAYS INSPECT THE ACTUAL PRODUCT PACKAGING AND CURRENT MANUFACTURER LABEL BEFORE PURCHASING OR CONSUMING FOOD.
You are solely responsible for determining whether a food product is appropriate for you or anyone for whom you are purchasing or preparing food.
1. Acceptance of These Terms
By using Gramm, you represent that:
- You have read and understand these Terms;
- You agree to be bound by these Terms; and
- You have the legal capacity to enter into these Terms under applicable law.
If you use Gramm on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.
2. Description of the Service
Gramm is a software application designed to provide tools that may include:
- Grocery unit-price calculations;
- Price-per-ounce, price-per-pound, price-per-serving, or similar mathematical comparisons;
- Shopping-list management;
- Product lookup through barcode scanning;
- Product and nutrition comparisons;
- Fitness-oriented nutrition comparisons;
- User-entered nutrition calculations;
- Calculation history;
- Favorites; and
- Optional paid features through Gramm Pro.
Features may change, be added, discontinued, limited, or modified at any time.
3. License to Use Gramm
Subject to your compliance with these Terms, Gramm grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Gramm for your personal:
- Shopping;
- Budgeting;
- Grocery-price comparison;
- Meal-planning; and
- General nutrition-comparison purposes.
This license does not transfer ownership of Gramm or any intellectual-property rights to you. You may not:
- Copy, reproduce, redistribute, or commercially exploit Gramm except as expressly permitted;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of Gramm except where applicable law expressly permits such activity;
- Remove or modify copyright, trademark, or proprietary notices;
- Circumvent technical restrictions or security mechanisms;
- Use Gramm to develop a competing product by unauthorized extraction or systematic use of the Service;
- Rent, lease, sublicense, sell, or transfer access to Gramm; or
- Use Gramm in a manner that violates applicable law.
We reserve all rights not expressly granted in these Terms.
4. Accuracy of Calculations and Product Information
Gramm performs mathematical calculations using information supplied by you and/or information obtained from public product databases. Examples of information that may be inaccurate include:
- Product prices;
- Package sizes;
- Serving sizes;
- Nutrition facts;
- Calories;
- Protein;
- Carbohydrates;
- Fat;
- Ingredients;
- Product names;
- Barcode associations;
- Product availability;
- Currency or unit information; and
- Other product metadata.
A mathematically correct calculation can still produce an incorrect result if the underlying information is incorrect. For example, if a database reports an incorrect package size or nutrition value, Gramm may produce a mathematically correct calculation based on incorrect input. You are responsible for reviewing inputs and results before relying on them.
5. Nutrition and Fitness Disclaimer
Gramm’s nutrition and fitness-related functionality is intended solely to help users compare and organize publicly available or user-entered information. Nothing in Gramm constitutes:
- Medical advice;
- Diagnosis;
- Treatment;
- Disease prevention;
- Personalized medical guidance;
- A prescription;
- A therapeutic recommendation; or
- Professional nutritional or dietary advice.
Individual nutritional needs vary substantially. If you have a medical condition, food allergy, dietary restriction, eating disorder, special nutritional requirement, or other health-related concern, consult an appropriately qualified healthcare professional or registered dietitian before making dietary decisions based on information displayed by Gramm.
6. Food Safety and Allergens
You are solely responsible for food-safety decisions.
Public databases and user-entered information may not contain every ingredient, allergen, cross-contact warning, formulation change, recall, or other safety information relevant to a product. Product formulations and labels can change without notice.
Before consuming a product, you should inspect the current physical product packaging, including:
- Ingredient lists;
- Allergen statements;
- Nutrition Facts;
- Serving-size information;
- Expiration or use-by information;
- Preparation instructions; and
- Applicable safety or recall information.
Never rely exclusively on Gramm for determining whether a product is safe for you or another person to consume.
7. Prices and Store Information
Gramm may allow you to enter or compare grocery prices.
Unless explicitly stated otherwise, Gramm does not guarantee that a displayed price represents the current price at any particular store. Prices can vary based on:
- Location;
- Store;
- Date and time;
- Promotions;
- Membership programs;
- Coupons;
- Taxes;
- Package size;
- Product variants; and
- Other retailer-specific conditions.
You are responsible for verifying the actual price before making a purchase.
8. Barcode Scanning and Public Databases
Gramm may use barcode scanning and public product databases to retrieve product information.
Barcode results may be incomplete or incorrectly associated with a product.
A successful barcode scan does not constitute verification that the retrieved product information is accurate or current. You should confirm product information against the physical product and manufacturer’s labeling.
9. Gramm Pro and Purchases
Gramm may offer optional paid functionality under the name Gramm Pro. Depending on the offer presented to you, Gramm Pro may be available as:
- A one-time purchase providing lifetime access to specified features; and/or
- A subscription providing access for a defined subscription period.
The exact price, duration, features, and purchase terms presented at the time of purchase control the applicable transaction.
9.1 Google Play Billing
Purchases made through the Android version of Gramm are processed through Google Play’s billing system. Gramm does not directly process your credit-card or bank-account information.
Google Play’s applicable terms, purchase conditions, refund rules, cancellation procedures, and payment policies govern the processing of purchases made through Google Play. For subscription purchases, cancellation generally must be performed through the applicable Google Play subscription-management controls.
9.2 Lifetime Purchases
Where Gramm offers a “lifetime” purchase, “lifetime” means the lifetime of the applicable Gramm product, service, or feature offering—not the lifetime of the purchaser. A lifetime purchase does not necessarily guarantee that every future Gramm feature will remain available indefinitely.
Unless otherwise required by applicable law, a lifetime purchase provides access to the specific Pro functionality described at the time of purchase, subject to these Terms and reasonable technical changes to the Service.
9.3 Refunds
Refunds for Google Play purchases are governed by Google’s applicable refund policies and procedures, together with any mandatory consumer rights under applicable law. Gramm does not independently control Google’s payment-processing or refund systems.
10. Intellectual Property
Gramm, including its software, user interface, design, branding, logos, graphics, text, and other original content, is owned by Gramm or its licensors and is protected by applicable intellectual-property laws.
These Terms grant you a license to use Gramm; they do not transfer ownership.
The name Gramm, the Gramm branding, and associated logos may constitute trademarks or other protected intellectual property. You may not use Gramm’s trademarks or branding in a way that suggests an unauthorized affiliation, endorsement, sponsorship, or partnership.
11. User-Entered Content
You may enter information into Gramm, including product information, shopping lists, prices, nutrition information, notes, and other content supported by the application (“User Content”).
You retain ownership of User Content to the extent you have rights in that content.
Because Gramm is designed as a local-first application, User Content is primarily stored locally on your device as described in the Privacy Policy. You are responsible for the accuracy, legality, and appropriateness of information you enter into Gramm.
12. Third-Party Services
Gramm may depend on or interact with third-party services, including:
- Google Play;
- Google ML Kit;
- Open Food Facts;
- UPCitemdb; and
- Third-party infrastructure used to deliver public product information or images.
Third-party services may be unavailable, inaccurate, changed, discontinued, or subject to terms and policies outside Gramm’s control. Your use of third-party services may also be subject to the third party’s separate terms and policies.
Gramm is not responsible for third-party services or for information supplied by third-party databases.
13. Availability and Changes to the Service
We may modify, suspend, restrict, or discontinue Gramm or any feature at any time.
Although we attempt to maintain reliable service, we do not guarantee that Gramm will:
- Always be available;
- Operate without interruption;
- Be free from errors or defects;
- Be compatible with every device or Android version;
- Remain available indefinitely; or
- Continue to support every feature or third-party service.
Some features may require Internet connectivity, device permissions, compatible hardware, or third-party services.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRAMM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. WE DO NOT WARRANT THAT:
- GRAMM WILL BE UNINTERRUPTED;
- GRAMM WILL BE ERROR-FREE;
- CALCULATIONS WILL ALWAYS BE CORRECT;
- PRODUCT DATABASE INFORMATION WILL BE ACCURATE OR CURRENT;
- STORE PRICES WILL BE ACCURATE;
- NUTRITION INFORMATION WILL BE COMPLETE OR CORRECT;
- BARCODE RESULTS WILL CORRECTLY IDENTIFY A PRODUCT; OR
- GRAMM WILL MEET YOUR PARTICULAR REQUIREMENTS.
Nothing in these Terms excludes a warranty or consumer protection right that cannot legally be excluded under applicable law.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRAMM AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, GRAMM. This includes, without limitation, losses arising from:
- Incorrect product information;
- Incorrect prices;
- Incorrect nutrition information;
- Incorrect calculations;
- Food allergies or dietary reactions;
- Food-safety issues;
- Purchases made based on information displayed by Gramm;
- Loss of locally stored data;
- Device failure;
- Third-party service outages;
- Internet connectivity issues; or
- Unauthorized access to your device or locally stored information.
To the maximum extent permitted by applicable law, Gramm’s total aggregate liability arising out of or relating to the Service will not exceed the greater of:
- The amount you paid to Gramm for the applicable Service during the twelve months preceding the event giving rise to the claim; or
- US $100.
Nothing in this section limits liability that cannot legally be limited or excluded under applicable law.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Gramm and its owners, operators, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:
- Your misuse of Gramm;
- Your violation of these Terms;
- Your violation of applicable law;
- Your User Content; or
- Your infringement or violation of another person’s rights.
This obligation does not apply to the extent caused by Gramm’s own unlawful conduct or liability that cannot legally be shifted to you.
17. Termination
You may stop using Gramm at any time.
We may suspend or terminate your access to Gramm if you materially violate these Terms or use Gramm unlawfully.
Upon termination, provisions that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute provisions—will continue to apply to the extent permitted by law.
18. Governing Law and Disputes
These Terms are governed by the laws of New Jersey, USA, without regard to its conflict-of-law principles, except to the extent applicable consumer-protection laws provide otherwise.
Before initiating formal legal proceedings, you agree to contact Gramm at support@gramm.mobile and provide a reasonable opportunity to resolve the dispute informally.
If a dispute cannot be resolved informally, it will be resolved in the courts or through another dispute-resolution process permitted by applicable law and located in New Jersey, subject to any mandatory rights you may have under the laws of your place of residence.
19. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may update the “Last Updated” date and, where appropriate, provide additional notice through Gramm or gramm.mobile.
Your continued use of Gramm after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
20. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly incorporated into Gramm, constitute the agreement between you and Gramm concerning your use of the Service. If there is a conflict between these Terms and a separate mandatory consumer right or applicable law, the mandatory legal requirement will control.
